BeerSteps Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the BeerSteps mobile application (“BeerSteps” or the “App”), provided by Fatback & Co LLC, a Florida limited liability company (“Fatback & Co,” “we,” “us,” or “our”).

By downloading, accessing, or using BeerSteps, you agree to these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

BeerSteps contains alcohol-related themes and is intended only for individuals who have reached the legal age to purchase and consume alcoholic beverages in the jurisdiction where they use the App.

By using BeerSteps, you represent that you meet the applicable legal-age requirement in your jurisdiction.

If you have not reached the applicable legal drinking age, you should not use BeerSteps.

2. About BeerSteps

BeerSteps is a fitness and entertainment application that tracks walking activity and expresses fitness progress using calorie-based beverage equivalents.

Depending on the features and permissions you choose to use, BeerSteps may track or display information such as:

• steps;
• walking distance;
• active calories;
• elevation;
• workout duration;
• completed workouts; and
• progress toward beverage calorie equivalents.

BeerSteps may access information through Apple HealthKit and Motion & Fitness with your permission and may save completed walking workouts to Apple Health.

BeerSteps does not sell, provide, or deliver alcoholic beverages.

3. “Earn Your Beer” and Beverage Equivalents

BeerSteps may use phrases or concepts such as “Earn Your Beer,” “beer earned,” beverage progress, calorie equivalents, or similar terminology.

These features are intended solely as fitness, informational, motivational, and entertainment concepts.

They do not mean that exercise makes alcohol consumption safe, healthy, medically appropriate, or advisable. Exercise does not eliminate the health effects, impairment, or other risks associated with consuming alcohol.

BeerSteps does not require, encourage, or recommend alcohol consumption.

You are never required or expected to consume the beverage represented by an equivalent or progress calculation.

4. Health and Fitness Disclaimer

BeerSteps is not a medical device and does not provide medical advice, diagnosis, treatment, or professional health advice.

Steps, calories, distance, elevation, workout duration, beverage equivalents, and other measurements or calculations provided by BeerSteps may be estimates. Results may differ from measurements produced by Apple, Apple Watch, other devices or applications, fitness equipment, or professional measurements.

You should not rely on BeerSteps to make medical or healthcare decisions.

Consult an appropriate healthcare professional before beginning or materially changing an exercise program when appropriate for your circumstances.

If you experience symptoms that concern you while exercising, stop exercising and seek appropriate medical assistance.

5. Alcohol Safety

If you choose to consume alcohol, you are responsible for doing so lawfully and responsibly.

BeerSteps does not represent that any quantity of alcohol is safe or appropriate for a particular individual.

BeerSteps’ calorie and beverage-equivalent calculations do not measure or estimate:

• blood alcohol concentration;
• intoxication;
• impairment;
• alcohol metabolism;
• sobriety; or
• your ability to drive or operate machinery safely.

Never use BeerSteps to determine whether you are safe to drive.

Do not drive, operate machinery, or engage in other dangerous activities while impaired.

6. Apple Health and Motion & Fitness

BeerSteps may request permission to access health and fitness information through Apple’s HealthKit, Apple Health, and Motion & Fitness technologies.

BeerSteps may also save completed walking workouts to Apple Health with your authorization, allowing those workouts to be available through Apple’s Health and Fitness ecosystem.

You control these permissions through Apple’s applicable privacy and system controls.

The availability and accuracy of fitness information may depend on factors outside Fatback & Co’s control, including your iPhone, Apple Watch, sensors, Apple Health configuration, permissions, operating-system version, and Apple’s software and services.

Revoking permissions may cause some BeerSteps features to stop working or provide incomplete information.

7. BeerSteps Premium

BeerSteps may offer a one-time in-app purchase known as BeerSteps Premium.

BeerSteps Premium may unlock additional features, including, depending on the version of the App:

• Siri workout controls;
• Home Screen and/or Lock Screen widget functionality;
• Live Activities; and
• other functionality identified as Premium within BeerSteps.

The exact functionality of BeerSteps Premium may evolve as BeerSteps and Apple’s platforms change.

Premium purchases are processed through Apple’s App Store and are subject to Apple’s applicable terms and purchase policies.

Fatback & Co does not directly receive or store your payment card or banking information.

Where supported by Apple, previously purchased Premium access may be restorable using the App Store account associated with the purchase.

Nothing in these Terms limits refund, cancellation, or consumer rights that cannot legally be excluded under applicable law or Apple’s applicable policies.

8. Siri, Widgets, and Live Activities

Some BeerSteps Premium functionality may rely on Apple technologies such as Siri, App Intents, widgets, Live Activities, Lock Screen functionality, or background workout execution.

Availability and behavior of these features may depend on Apple’s operating system, device state, permissions, hardware, system policies, and other circumstances outside Fatback & Co’s control.

Fatback & Co does not guarantee that every system-integrated feature will operate in every circumstance or on every supported Apple device.

9. Advertising

The free version of BeerSteps may display third-party advertising through Google AdMob.

Advertising availability, content, personalization, frequency, and delivery may vary based on factors including:

• your region;
• applicable privacy requirements;
• your consent or privacy choices;
• advertising inventory;
• network availability; and
• Google’s advertising systems.

Fatback & Co does not necessarily endorse the products, services, claims, or organizations appearing in third-party advertisements.

BeerSteps Premium may remove advertising as described within the App.

10. Privacy

Your use of BeerSteps is also subject to the BeerSteps Privacy Policy, which explains how information is handled by BeerSteps and relevant third-party services.

The Privacy Policy is available through the Fatback & Co website and, where provided, within BeerSteps.

HealthKit and fitness information is subject to additional protections described in the BeerSteps Privacy Policy.

11. Notifications

If you grant notification permission, BeerSteps may provide notifications related to App functionality, such as workout completion or fitness and beverage-progress events.

You can manage BeerSteps notification permissions through Apple’s system settings.

Delivery of a notification is not guaranteed and may depend on Apple’s notification services and your device configuration.

12. Accuracy and Availability of Fitness Data

BeerSteps relies on information supplied by device sensors, Apple frameworks, HealthKit, Motion & Fitness, and other system services.

Accordingly, BeerSteps cannot guarantee that:

• every step will be counted;
• calorie estimates will be exact;
• distance or elevation will always be exact;
• workout information will always update in real time;
• data shown by BeerSteps will exactly match Apple Health or Fitness; or
• system-integrated features will always remain available while BeerSteps is backgrounded or otherwise not actively running.

Differences between BeerSteps and other fitness applications or devices do not necessarily indicate an error.

13. Acceptable Use

You agree not to:

• use BeerSteps for an unlawful purpose;
• intentionally interfere with or disrupt the App;
• attempt to gain unauthorized access to the App or related systems;
• attempt to circumvent BeerSteps Premium purchase requirements;
• reproduce, modify, distribute, sell, or commercially exploit BeerSteps except as permitted by law or with our permission; or
• reverse engineer or attempt to derive BeerSteps’ source code except to the extent applicable law expressly permits such activity notwithstanding this restriction.

14. Intellectual Property

BeerSteps and its original software, branding, graphics, text, interface designs, trademarks, logos, and other original content are owned by or licensed to Fatback & Co LLC and are protected by applicable intellectual-property laws.

Subject to these Terms, Fatback & Co grants you a limited, personal, revocable, non-exclusive, non-transferable license to use BeerSteps for its intended purpose on devices that you own or control, subject to applicable App Store rules.

No ownership interest in BeerSteps is transferred to you.

15. Third-Party Services

BeerSteps relies on third-party technologies and services, including services provided by Apple and Google.

These may include:

• the App Store;
• StoreKit;
• Apple Health and HealthKit;
• Motion & Fitness;
• Siri;
• widgets and Live Activities;
• Google AdMob; and
• Google’s User Messaging Platform.

Those services are operated by their respective providers and may be governed by separate terms and privacy policies.

Fatback & Co does not control third-party platforms and cannot guarantee their uninterrupted availability or continued functionality.

16. App Availability and Changes

We may update, maintain, modify, improve, replace, or discontinue portions of BeerSteps as the App, operating systems, legal requirements, and third-party services evolve.

Features may vary by device, operating-system version, country, region, permissions, Premium status, or availability of third-party services.

We do not guarantee that every feature will remain available indefinitely.

Where applicable law gives you mandatory rights regarding purchased digital content or services, nothing in these Terms limits those rights.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, BeerSteps is provided on an “as is” and “as available” basis.

Fatback & Co does not warrant that BeerSteps will always be uninterrupted, error-free, completely accurate, or available on every device or in every location.

Fitness measurements, calculations, beverage equivalents, and other information presented by BeerSteps should not be considered guaranteed measurements.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions above apply only to the extent permitted by law.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Fatback & Co LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, BeerSteps.

Fatback & Co is not responsible for decisions to consume alcohol based on fitness activity, calorie expenditure, beverage equivalents, or other information presented by BeerSteps.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protections that may apply in your jurisdiction.

19. Governing Law and Consumer Rights

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles, except to the extent applicable law in your country or region requires otherwise.

If you are a consumer in the European Economic Area, United Kingdom, or another jurisdiction that provides mandatory consumer protections, nothing in these Terms limits or excludes rights or remedies that cannot lawfully be waived or restricted.

Nothing in these Terms is intended to deprive you of protections provided by the mandatory laws applicable in your place of residence.

20. Apple-Specific Terms

BeerSteps is made available through Apple’s App Store. You acknowledge that these Terms are between you and Fatback & Co LLC, not Apple, and that Fatback & Co, not Apple, is responsible for BeerSteps and its content, subject to applicable law.

Your use of BeerSteps must comply with the applicable App Store terms and usage rules.

To the extent required by Apple’s applicable terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.

Nothing in these Terms alters or limits rights or obligations established by Apple’s applicable App Store terms.

21. Termination

You may stop using BeerSteps at any time by deleting the App.

We may restrict or terminate access to BeerSteps where reasonably necessary because of misuse, unlawful conduct, security concerns, or other violations of these Terms, subject to applicable law.

Sections of these Terms that by their nature should survive termination will continue to apply.

22. Changes to These Terms

We may update these Terms when BeerSteps, applicable laws, or third-party services change.

When we do, we will update the Last Updated date at the top of these Terms.

Where required by applicable law, we will provide additional notice regarding material changes.

Your continued use of BeerSteps following changes constitutes acceptance of the updated Terms only to the extent permitted by applicable law.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible, and the remaining provisions will continue in effect.

24. Entire Agreement

These Terms, together with the BeerSteps Privacy Policy and any additional terms expressly presented in connection with a particular BeerSteps feature, constitute the agreement between you and Fatback & Co regarding your use of BeerSteps, subject to applicable mandatory law.
